Yale Smart Products – شروط المنتجات
These terms and conditions (“Product Terms”) apply to your use of certain Yale products that connect to the internet and are controlled through the App (“Smart Products”). These Product Terms supplement the Yale Home User Terms and apply to your use of the Smart Products. All terms in the Yale Home User Terms apply to these Product Terms. For the avoidance of doubt, the Smart Products are included within the term “Services” as defined in the Yale Home User Terms.
Please read these Product Terms carefully.
Terms not defined in these Product Terms will have the meaning set forth in the Yale Home User Terms or Subscription Terms.
By clicking "I Agree" (or equivalent) on the App, website, or platform used to access the App, you agree to be bound by these Product Terms. If you do not agree to these Product Terms, do not click "I Agree" (or equivalent).
If you do not agree to these Product Terms, you may return the Smart Product intended for use with the App (in its original, unused condition) within thirty (30) days of purchase (or within the return period specified by the retailer from whom you purchased the product, whichever is longer) for a refund. In this case, you must also stop using and uninstall the App. This applies in addition to any other rights you may have regarding the return of the Smart Product under your local law or as set forth in the terms and conditions of the retailer from whom you purchased the product.
1. About us
We are Security & Risk Communications Limited (trading as “Yale” and forming part of the ASSA ABLOY group of companies), a company incorporated in Ireland (registration number 417550), whose address is Parkway Business Centre, Ballymount, Dublin 24 (referred to in this document as “we” and “us”).
2. Third-party software included in smart products
The non-hardware/firmware in Smart Products may contain or be distributed with third-party software, including open source software. Open source software is subject to its own applicable license terms. You can find the applicable copyright notices and open source software terms here . The copyright in third-party software and open source software is owned by the respective copyright holders indicated in those notices/terms.
3. Additional Terms
3.1 These Product Terms apply in addition to other terms that govern your use of the App and Smart Products, namely:
• Yale Smart Products Privacy Notice ;
• Yale Smart Products Subscription Terms and Yale Home Subscription Privacy Notice (if you have signed up for Subscription Services);
• Legal guarantees ;
• Regulatory documents for products .
In the event of any conflict between these Product Terms and these other terms, the provisions of these Product Terms shall prevail with respect to the use of the Smart Products only, and where permitted by law. It is your responsibility to review and comply with all applicable terms and agreements relating to your use of the App and Services.
4. Your responsibility for monitoring alarms
If your Smart Products include any alarm or notification features, it is your responsibility to monitor any signals and/or notifications and to promptly close any alarm events that do not actually indicate illegal behavior. You agree to monitor and prevent false alarms and bear sole responsibility for false alarms related to your Smart Products.
5. You are responsible for any content uploaded through the Smart Products.
5.1 “Content” means all audio, video, images, text and other types of content captured by the Smart Products or provided to us (including content posted by you) in connection with the use of the Smart Products.
5.2 You are solely responsible for all content you post and undertake to:
(a) you own the intellectual property rights in the Content and grant the rights (called a license) described below,
(b) that you have sought appropriate permission from any person whose details or likeness may appear in the clip;
(c) that the use of the Content you post on or through the Smart Products does not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights or other rights of any person.
5.3 You grant us a non-exclusive (i.e., you can license the content you post to others), royalty-free (i.e., we do not pay you for this license), sublicensable (i.e., we can license the content you post to others, for example, to service providers who help us provide the Services), and worldwide (i.e., the license applies anywhere in the world) right to use the content shared through the Smart Products for the purposes of providing the Services to you.
5.4 We do not claim any intellectual property rights in the content you post. Except for the rights you grant us under these Product Terms, you retain all of your rights in the content you post.
5.5 You agree not to use, reproduce, modify, upload, publish, transmit, distribute, display or otherwise exploit any Content that:
(a) is not owned by you without the prior express written consent of its respective owners;
(b) is defamatory, libelous, obscene, pornographic, abusive, indecent, threatening, harassing, hateful, insulting, or otherwise unlawful;
(c) for any purpose that infringes in any way upon the rights of any third parties.
5.6 You may not use any Smart Products, or permit the use of any Smart Products, for any unlawful purpose. For example, you may not use Smart Products to obtain or record video in any place where individuals may have a reasonable expectation of privacy, including, for example, restrooms, dressing rooms, or changing rooms. You must also take all necessary steps to alert individuals entering the facility to the possibility of video or audio recording.
5.7 We reserve the right to remove any infringing or inappropriate content from the Smart Products (and any cloud storage) at any time at our sole discretion, but we are not obligated to do so under applicable law. If you use the Smart Products for any unlawful purpose, you may incur legal liability to us (including for any costs incurred by you).
6. Features of Artificial Intelligence Identification
6.1 If your Smart Product includes advanced artificial intelligence (“AI”) identification features, it includes the ability to recognize motion (within a grid pattern) and the identity of people within its visual data.
6.2 There are inherent limitations to smart product technology and AI algorithms, meaning that AI will not always capture these elements. These events may include, for example, environmental conditions, light intensity, object contrast, and programming limitations.
6.3 By using any AI features, you acknowledge that they should not be used in any situation where identification accuracy is important, and that we will not be liable, to the fullest extent permitted by law, for any inaccuracies or identification errors resulting from the use of such technology.
7. Updates to these Product and Smart Product Terms

8. التثبيت وحالات الانقطاع

9. القيود

10. مسؤوليتنا عن الخسائر أو الأضرار التي لحقت بمنتجاتك
10.1 الخسائر والأضرار التي لا نتحمل مسؤوليتها. إننا لا نتحمل المسؤولية أمامك عن أي خسائر أو أضرار، شريطة أن نكون قد تصرفنا باجتهاد مهني وإلى الحد الذي يسمح به القانون المعمول به، إلا في الحالات التالية:

10.3 We are not responsible for events beyond our reasonable control. Our goal is to make the Smart Products highly available and reliable; however, they may not always be available. The Smart Products may experience occasional outages and disruptions for a variety of reasons beyond our control, including Wi-Fi and mobile network failures, coverage limitations, service provider operating times, and acts of God. In addition, these Smart Products rely on or work with a number of products and services provided by or in conjunction with third-party providers, including third-party providers we use to provide networking and storage, as well as other services you may choose to connect your product to, as described under the "Important Information About Using Your Product with Other Products and Services" section of the Yale Home User Terms . These third-party products and services are not under our control, but their operation may affect the use and reliability of the products.
To the extent permitted by law, we are not liable for loss or damage caused by events beyond our reasonable control, including loss or damage caused by any such products and services provided by third parties.
10.4 Other Limitations on Products. In addition to the above, the Smart Products are provided for general informational purposes only. They do not provide advice on which you should rely. You should obtain professional or specialist advice before taking or refraining from any action based on information obtained from the App or Services. Although we make reasonable efforts to update the information provided by the App and Services, we make no representations or warranties, express or implied, that such information is accurate, complete, or up-to-date.
10.5 Please back up any content and data related to the Smart Products. We recommend that you back up any User Content or data used in connection with the Smart Products to protect yourself in the event of problems with the Smart Products.
10.6 Verify that the Smart Products are suitable for you. The Smart Products have not been specifically developed to meet your individual requirements. Please ensure that their features and functions (as described in the App or as described by the retailer) meet your requirements. Furthermore, your Smart Products and these Product Terms are designed and intended only for use in certain countries. We cannot be held responsible for any use of the Smart Products outside the country in which they were purchased.
11. Other important terms
11.1 Even if we delay enforcing these Product Terms, we may still enforce them later. If we do not immediately insist that you do anything required of you under these Product Terms, or if we delay taking steps against you in respect of your breach of these Product Terms, that will not mean you do not have to do those things, and it will not prevent us from taking steps against you at a later time, provided we are permitted to do so under applicable law.
11.2 If a court finds part of these Product Terms to be unlawful, the remaining provisions will remain in effect. Each paragraph of these Product Terms applies separately. If any court or competent authority decides that any of these paragraphs is unlawful, the remaining paragraphs will remain in full force and effect.
11.3 Laws that apply to these Product Terms and where you may bring legal claims. Any dispute arising out of or in connection with this Contract, including any doubt as to its existence, validity, or termination, shall be referred to and finally decided by arbitration under the Rules of the London Court of International Arbitration (LCIA), which Rules are deemed incorporated by this clause. The number of arbitrators shall be limited to one. The seat or legal place of arbitration shall be London. The language to be used in the arbitration proceedings shall be English. The law governing the Contract shall be the substantive law of England and Wales.
