Yale Išmanieji Produktai – Gaminio Sąlygos
These terms ( Product Terms ) apply to certain Yale products that are capable of connecting to the Internet and are controlled by Apps ( Smart Products ). These Product Terms supplement the Yale Home User Terms and apply to your use of Smart Products. All terms of the Yale Home User Terms apply to these Product Terms. For the avoidance of doubt, Smart Products are included in the Services as defined in the Yale Home User Terms.
PLEASE READ THESE PRODUCT TERMS AND CONDITIONS CAREFULLY.
Terms not defined in these Product Terms have the meaning set forth in the Yale Home User Terms or Subscription Terms.
BY CLICKING AGREE (OR THE APPLICABLE PROMPT) ON THE APP, WEBSITE OR PLATFORM ON WHICH THE APP IS MADE AVAILABLE, YOU AGREE TO BE BOUND BY THESE PRODUCT TERMS. IF YOU DO NOT AGREE TO THESE PRODUCT TERMS, DO NOT CLICKING AGREE (OR THE APPLICABLE PROMPT).
If you do not agree to these Product Terms, you may return the Smart Product that will be used with the App (in its original, unused condition) within thirty (30) days of the date of purchase (or within the return period offered by the retailer from whom you purchased the product, whichever is longer) for a refund. In such event, you should also cease using and uninstall the App. This provision is in addition to any other rights to return the Smart Product that you may have under local law or as set forth in the terms and conditions of the retailer from whom you purchased the Smart Product.
1. WHO WE ARE
We, Security & Risk Communications Limited (trading name Yale and part of the ASSA ABLOY group of companies), are a company incorporated in Ireland (registered number 417550) whose registered office is at Parkway Business Centre, Ballymount, Dublin 24 ( we, us or our ).
2. THIRD-PARTY SOFTWARE INCLUDED IN SMART PRODUCTS
The software/hardware included in the Smart Products may include or be distributed with third-party software, including open source software. Open source software is subject to separate applicable license terms. Copyright notices and applicable open source terms can be found here . The copyrights of third-party and open source software belong to the respective copyright holders identified in these notices/terms.
3. ADDITIONAL TERMS
3.1 These Product Terms apply in conjunction with other terms governing your use of the App and Smart Products:
• Yale Smart Products Privacy Notice ;
• Yale Smart Products Subscription Terms and Yale Home Subscription Privacy Notice (where you subscribed to the subscription services);
• Legal guarantees ; and
• Product regulatory documents .
If there is any conflict between the Product Terms and other terms, the provisions of these Product Terms shall prevail solely for the use of smart products. You are responsible for reviewing and complying with all applicable terms and agreements relating to your use of the App and Services.
4. YOUR RESPONSIBILITY TO OBSERVE WARNINGS
If your Smart Products have any alarm or notification features, it is your responsibility to monitor all alarms and/or notifications in a timely manner and to suppress any alarm events that do not actively report unauthorized behavior. You agree to monitor and prevent false alarms and are solely responsible for false alarms associated with your Smart Products.
5. YOUR RESPONSIBILITY FOR ANY CONTENT UPLOADED THROUGH SMART PRODUCTS
5.1 Content means all audio, video, images, text and other types of content captured by the Smart Products or provided to us (including content posted by you) in connection with the use of the Smart Products.
5.2 You are solely responsible for all of your content and you promise that:
(a) you own the intellectual property rights in the Content and grant the rights described below (so-called licenses),

5.3 Jūs suteikiate mums neišimtinę (tai reiškia, kad galite licencijuoti savo turinį kitiems), nemokamą (tai reiškia, kad mes nemokame jums už šią licenciją), visame pasaulyje (tai reiškia, kad licencija taikoma bet kurioje pasaulio vietoje), sublicencijuojamą (tai reiškia, kad galime licencijuoti jūsų turinį kitiems, pvz., paslaugų teikėjams, kurie mums padeda teikti Paslaugas) teisę naudoti (įskaitant atkurti, modifikuoti, įkelti, skelbti, perduoti, platinti, rodyti ar kitaip naudoti) turinys, bendrinamas per išmaniuosius produktus, siekiant suteikti jums Paslaugas. Ši licencija suteikiama, kai tik Turinys įkeliamas per išmaniuosius produktus ir intelektinės nuosavybės teisių į Turinį apsaugos laikotarpiu.
5.4 Mes neteikiame pretenzijų dėl intelektinės nuosavybės teisių į jūsų turinį. Išskyrus teises, kurias mums suteikiate pagal šias Produktų sąlygas, jūs išlaikote visas savo turinio teises.
5.5 Jūs sutinkate, kad negalite naudoti, atkurti, modifikuoti, įkelti, skelbti, perduoti, platinti, rodyti ar kitaip naudoti jokio Turinio:
(a) kuris nepriklauso jums be išankstinio atitinkamų savininkų raštiško sutikimo;
(b) kuris yra šmeižikiškas, nepadorus, pornografinis, įžeidžiantis, grasinanti, priekabiaujantis, neapykantą keliantis ar kitaip neteisėtas; ir
(c) bet kokiam tikslui, kuris bet kokiu būdu prieštarauja trečiųjų šalių teisėms.
5.6 Jūs negalite naudoti jokių išmaniųjų produktų ar leisti naudoti bet kokius išmaniuosius produktus jokiems neteisėtiems tikslams. Pavyzdžiui, nenaudokite išmaniųjų gaminių vaizdo įrašams gauti ar įrašyti bet kurioje vietoje, kurioje asmuo gali turėti pagrįstų privatumo lūkesčių, įskaitant, pavyzdžiui, tualetus, persirengimo zonas ar persirengimo zonas. Jūs taip pat turite imtis visų būtinų veiksmų, kad įspėtumėte asmenis, kurie patenka į nuosavybę, apie galimybę įrašyti vaizdo ar garso įrašus.

6. AI IDENTIFIKAVIMO FUNKCIJOS
6.1 Jei jūsų išmaniajame gaminyje yra pažangios dirbtinio identifikavimo (AI) funkcijos, tai apima galimybę identifikuoti judesius (tinklelio pagrindu sudarytame išdėstyme) ir asmenis vaizdo sraute.
6.2 Išmaniojo gaminio technologija ir dirbtinio intelekto algoritmai turi būdingų apribojimų, o tai reiškia, kad DI ne visada užfiksuos šiuos elementus. Tokie įvykiai gali būti, pavyzdžiui, aplinkos sąlygos, matomumas šviesoje, objektų kintamumas ir programavimo apribojimai.
6.3 Naudodami bet kokias AI funkcijas, jūs pripažįstate, kad AI funkcija neturėtų būti naudojama jokiose situacijose, kuriose svarbus identifikavimo tikslumas ir kad mes neatsakome už jokius netikslumus ar klaidingus identifikavimus, atsiradusius naudojant šią technologiją.
7. ATNAUJINIMAI EL. GAMINIO SĄLYGOMS IR IŠMANIEMS PRODUKTAMS
7.1 Mums gali tekti keisti šias Gaminio sąlygas ir Išmaniuosius produktus atsižvelgiant į teisės aktų ar geriausios praktikos pokyčius, dėl trečiųjų šalių, kuriomis pasikliaujame teikdami Programėlę, Paslaugas ar Išmaniuosius produktus, padarytų pakeitimų ar apribojimų arba dėl mūsų įdiegtų papildomų funkcijų ar naujų produktų.
7.2 Apie bet kokius pakeitimus jus įspėsime ne vėliau kaip prieš trisdešimt (30) dienų, išsiųsdami jums el. laišką su išsamia informacija apie pakeitimus ir (arba) pranešdami apie pakeitimus per jūsų Vartotojo paskyrą. Pranešdami apie pakeitimus, nurodysime, ką galite daryti, jei nesutinkate su pakeitimais, įskaitant tai, kaip pasinaudoti teise nutraukti šią mūsų sutartį dėl Išmaniųjų gaminių naudojimo.
7.3 Retkarčiais galime kurti pataisymus, klaidų pataisymus, atnaujinimus, atnaujinimus ir kitus pakeitimus, kad pagerintume išmaniųjų produktų veikimą, ir dėl šių priežasčių galime paprašyti jūsų juos atnaujinti. Apie tokius naujinius būsite informuoti ir galėsite jų neįdiegti. Vis dėlto, jei to nepadarysite, galite rizikuoti saugumu, apriboti savo išmaniojo gaminio ir paslaugų funkcijas arba visiškai negalėsite jų naudoti.Išmanusis gaminys visada atitiks jums pateiktą aprašymą, kai jį gausite.
8. MONTAVIMAS IR PERTRAUKIMAI
8.1 Išskyrus atvejus, kai Yale jums suteikė diegimo paslaugą, esate atsakingi už išmaniųjų produktų diegimą ir naudojimą pagal instrukcijas. Jei išmanusis gaminys yra netinkamai sumontuotas arba jei jis ar bet kuris iš jo jutiklių yra už aptikimo diapazono ribų arba jam trukdo ar trukdo sienos, baldai, asmeninė nuosavybė ar kiti daiktai, galite patirti klaidingų pavojaus signalų, aptikimo ir kitų naudojimo trikčių.
8.2 Įdiegę išmaniuosius gaminius, esate atsakingi už jų (ir visų susijusių jutiklių, komponentų ir periferinių įrenginių) veikimo ir ryšio, kaip numatyta ir suprojektuoto, tikrinimą, o po to reguliariai tikrinkite ir prižiūrėkite išmaniuosius gaminius. Prireikus išmaniųjų gaminių baterijas turite pakeisti patys.
8.3 Išmaniųjų produktų ir paslaugų veikimas gali būti laikinai sustabdytas dėl saugumo priežasčių, sistemos gedimo, techninės priežiūros ir remonto ar kitų aplinkybių, kurių mes negalime pagrįstai kontroliuoti. Dėl tokių sustabdymų pobūdžio galime negalėti jus iš anksto informuoti, tačiau mes jus informuosime, kai tik įmanoma. Kiek leidžia įstatymai (tačiau atsižvelgiant į bet kokias su išmaniuoju gaminiu pateiktas teisines garantijas), jūs negalite turėti teisės gauti jokios kompensacijos už šiuos laikinus sustabdymus. Jei pastebėjote ilgalaikius šios rūšies paslaugų sutrikimus, pirmiausia kreipkitės į klientų aptarnavimo skyrių.
9. APRIBOJIMAI
9.1 Be Naudotojo sąlygose nustatytų Paslaugų apribojimų, jūs pripažįstate ir sutinkate, kad Yale neatsako už jokią žalą, kuri tariamai atsirado dėl Paslaugų neatitikimo ar vėlavimo atspindėti dabartinę būseną ar pranešimus, kiek tai leidžiama pagal įstatymus. Be to, išmanieji produktai ir paslaugos nėra skubių pranešimų sistema ir jų negalima naudoti tokiu būdu. Išskyrus konkrečiai nurodytus atvejus, susijusius su tam tikromis prenumeratos paslaugomis, Yale neatsako už skubios pagalbos tarnybų išsiuntimą į jūsų namus avarijos atveju.
9.2 Jūs esate atsakingi už visus mokesčius ir išlaidas, taikomus atitinkamiems trečiųjų šalių produktams ir paslaugoms, ir už visų galiojančių sutarčių, naudojimo sąlygų / paslaugų ir kitų jūsų produktų ir paslaugų teikėjų (įskaitant interneto paslaugų teikėjus ir mobiliųjų įrenginių teikėjus) politikų laikymąsi.
9.3 Mes neteikiame jokių pažadų dėl bet kokio turinio, esančio arba pasiekiamo naudojantis išmaniaisiais produktais, ir neatsakome ir neatsakome už medžiagos, esančios arba pasiekiamos naudojantis išmaniaisiais produktais, tikslumą, autorių teisių laikymąsi, teisėtumą ar padorumą.
9.4 Kiek leidžia įstatymai, mes neatsakome už žalą ar atsakomybę, atsiradusią dėl:
(a) išmaniųjų gaminių ir paslaugų naudojimą ne pagal paskirtį, kuriam jie sukurti ar skirti, arba naudojimą netinkamoje temperatūroje, drėgnyje ar kitomis aplinkos sąlygomis;
(b) išmaniųjų produktų ar paslaugų naudojimą pažeidžiant instrukcijas; arba
(c) įprasto nusidėvėjimo ar senėjimo, netinkamo remonto, veikimo ar techninės priežiūros, prijungimo prie netinkamo maitinimo šaltinio arba, kiek leidžiama pagal įstatymą, bet kurio kito subjekto, išskyrus Yale įgalioto, bandymo taisyti.
10. MŪSŲ ATSAKOMYBĖ UŽ JŪSŲ PATIRTUS NUOSTOLIUS AR ŽALĄ
10.1 Mes neatsakome už nuostolius ir žalą. Jei elgėmės profesionaliai ir kiek leidžia galiojantys įstatymai, mes neprisiimame atsakomybės už nuostolius ar žalą, nebent jie yra:
(a) dėl to, kad mes nesilaikome šių Gaminio sąlygų, dėl mūsų didelio aplaidumo ar tyčinio nusižengimo, arba
(b) pagrįstai numatyti tuo metu, kai sutikote su šiomis Gaminio sąlygomis.
We do not exclude or limit our liability to you in any way where it would be unlawful to do so, and nothing in these Terms affects any legal rights that you always have as a consumer or that you cannot contractually agree to vary or waive.
10.2 We are not liable for business losses. The Product is intended for home and private use. If you use the Products for commercial, business or resale purposes, to the extent permitted by law, we will not be liable for any loss of profits, business losses, business interruption or loss of business opportunity.
10.3 We are not responsible for events beyond our reasonable control. We aim to make the Smart Products highly reliable and available, but they may not be available all the time. The Smart Products may occasionally fail or become unavailable for a variety of reasons beyond our control, including disruptions and coverage limitations of your Wi-Fi and mobile network, service provider disruptions and acts of God. They also rely on or interact with various third party products and services, including third party service providers we use for networking and storage, and other services to which you may choose to connect your Product, as described in the Important Information About Using Your Product with Other Products and Services section of the Yale Home User Terms . We do not control these third party products and services, but their operation may affect the use and reliability of the Products.
To the extent permitted by law, we are not liable for any loss or damage arising from events beyond our control, including loss or damage arising from any third-party products and services.
10.4 Other Product Limitations. In addition, Smart Products are provided for general informational purposes only. They do not constitute advice on which you should rely. You should obtain professional or specialist advice before taking or refraining from taking any action based on information obtained from the App or Services. While we use reasonable efforts to update the information provided in the App and Services, we make no representations, warranties or guarantees, express or implied, that such information is accurate, complete or up-to-date.
10.5 Backing up content and data associated with Smart Products. We recommend that you create a backup of any content and data used with Smart Products to protect yourself in the event of problems with Smart Products.
10.6 Check that Smart Products are suitable for you. Smart Products are not designed to meet your individual requirements. Please check that their features and equipment (as described in the app or by your retailer) meet your requirements. In addition, your Smart Products and these Product Terms are intended for use in certain countries only. We cannot be held responsible for any use of the Smart Products outside the country in which you purchased the Smart Products.
11. OTHER IMPORTANT TERMS
11.1 Even if we delay in enforcing these Product Terms, we may still enforce them at a later date. If we do not immediately require you to take any action that you are required to take under these Product Terms, or if we delay in taking action against you because you have breached these Product Terms, this will not mean that you are not required to take that action and will not prevent us from taking action against you at a later date if we are permitted to do so under applicable law.
11.2 If a court finds any part of these Product Terms to be unlawful, the remaining part will remain in full force and effect. Each paragraph of these Product Terms will operate separately. If any court or relevant authority finds any of them to be unlawful, the remaining parts will remain in full force and effect.
1.1 What laws apply to these Product Terms and where you can bring a claim. These Product Terms are governed by the laws of the country where you live and you can bring a claim in the courts of the country where you live.
